Terms and Conditions

These terms and conditions (the “Agreement”) is the agreement between you, the Customer (whom we refer toas “you”, “your” or “the Customer” in this Agreement), and us, Q Lifestyle Ltd(“QLL”), a Mauritius company. Please read this Agreement carefully before using the Facility (as defined below). Bycontinuing to access or use the Facility made available through this Webpage or by transacting through or on it,you are agreeing to all of the terms and conditions contained in this Agreement. If you do not accept any of theterms and conditions in this Agreement, please discontinue your access to this Webpage and use of the Facility.

  1. Definitions

(a) “Facility” means the online payment facility or service provided by the Payment Service Provider (as defined below).

(b) “Fee(s)” means any and all fees payable to QLL by QVI club members including Usage Fee, Guest Certificate Fee and any other fees due for services provided by QLL.

(c) “Payment Service Provider” means The Mauritius Commercial Bank Ltd (MCB) or any other company with whom QLL has an agreement or arrangement to provide payment services or facilities.

(d) “Webpage” means QVI’s payment webpage which you are directed to through the link emailed to you.

  1. Applicability

This Agreement governs the use of this Webpage, supply of the services by QLL and/or Facilities by the Payment Service Provider.

  1. Age

To be eligible to use the Facility, you must be 18 years of age or over, based on the age of majority in your jurisdiction, and have full power and authority to enter into this Agreement.

  1. Information

You warrant that all information supplied by you in using the online payments facility or during the course of this Agreement is true, complete and accurate. Failure to provide accurate information may subject you to civil and criminal liabilities.

We accept no liability if payment is refused or declined by the Payment Service Provider or credit/debit card supplier due to your failure to supply the correct card details or other reasons.

  1. Confirmation of Payment

You will receive a confirmation of your payment via email from us and the Payment Service Provider as well as an on-screen confirmation after you successfully make the payment.

  1. Refund Policy

We do not have refund policy for any payment of Fee made but under certain circumstances and subject to the validity of the QVI club membership, week entitlement and/or package expiration, the management of QVI club may have the discretion to allow a refund. In any event of a refund being allowed, no cash refund will be given and all payments made will be credited back into your QVI accounts.

  1. Links To and From Other Websites

This Webpage contains a link to our Payment Service Provider’s website whose data protection and privacy policies may differ from QLL. We assume no responsibility for the contents, data protection and privacy policies of the Payment Service Provider’s website and we encourage you to consult the terms and conditions and/or privacy policy found on the Payment Service Provider’s website.

  1. Intellectual Property Rights

Please refer to our Terms of Use at http://www.qviclub.com which forms part of this Agreement.

  1. Governing Law and Jurisdiction

This Agreement shall be governed and construed in accordance with the laws of Malaysia.  Any dispute or issue arising out of, or in connection with, this Agreement shall be dealt with by the Courts of Malaysia to which you and QLL irrevocably submit.

  1. General

This Agreement may be changed/amended/revised from time to time. All changes/amendments/ revisions will be posted on this Webpage, and your use of this Webpage after such changes have been posted will constitute your agreement to the modified Agreement and all of the changes/ amendments/revisions.

QLL reserves the right at any time to terminate, suspend or cancel your account in cases of fraud or if there is a reasonable suspicion of fraud, violations of law or regulations and abusive or illegal activity. Where necessary, QLL will contact and cooperate with the appropriate law enforcement authorities in addition to taking other measures it deems necessary in accordance with the requirements of the applicable law.  Without prejudice to the foregoing, QLL further reserves the right to unilaterally, for any or no reason, without the imposition of penalties and without notice to terminate, suspend or cancel your account.
